2257 COMPLIANCE STATEMENT CONCERNING THE CONTENT ON THUMBBUZZ.COM
In compliance with United States Code, Title 18, Section 2257, all models,
actors, actresses and other persons who appear in any visual depiction of
sexually explicit conduct appearing or otherwise contained in or at
THUMBBUZZ.COM were over the age of eighteen years at the time of the creation
of such depictions. Records required to be maintained pursuant to U.S.C. Title
18, Section 2257 are not required to be kept for the images on ThumbBuzz.com
due to the nature of the images. All images of the models, actors, actresses
and other persons who appear in any visual depiction are done so
not displaying a sexually explicit act.
"Sexually explicit conduct" means sexual intercourse, including
genital-genital, oral-genital, anal-genital, or oral-anal contact, whether
between persons of the same or opposite sex. The term also includes images
depicting bestiality, masturbation, sadistic or masochistic abuse, or
lascivious exhibition of the genitals or pubic area of any person.
(2) "sexually explicit conduct" means actual or simulated-
(A) sexual intercourse, including genital-genital, oral-genital, anal-genital,
or oral-anal, whether between persons of the same or opposite sex;
(B) bestiality;
(C) masturbation;
(D) sadistic or masochistic abuse; or
(E) lascivious exhibition of the genitals or pubic area of any person;

The 2257 law
although often difficult to understand does spell out in very plain
English the term "Sexually Explicit Conduct" as shown above! The only
conduct of question can be found in section E. lascivious. Since 18
U.S.C.A. § 2257 does not spell out the meaning of lascivious, we have gone
to the "Merriam-Webster's Dictionary of Law" as a source definition.
Reflecting or producing sexual desire or behavior that is considered
indecent or obscene. Even the definition is questionable, as anything that
reflects the exhibition of the genitals or pubic area of any person can be
considered to produce a sexual desire or behavior that is considered
indecent or obscene to someone in the United States!
With this in
mind THUMBBUZZ.COM and it's associates have take the approach that "The
Majority" of US Citizens do not feel that an image of a nude female body
is a lascivious exhibition of the genitals or pubic areas, rather a form
of art or self expression. If the laws intent was to consider this as
anything else the definition being as exact as it is wrote would have
spelled it out. In addition if the law is taken to say "any genitals or
pubic areas" then every person who owns an image of art depicting a nude
female body must also hold the require 2257 documents.
